1. Introduction and Acceptance
Welcome to HAQQ Transportation. These Terms and Conditions govern the transportation services provided by HAQQ Transportation (“HAQQ Transportation,” “HAQQ,” “we,” “us,” or “our”) to passengers, their representatives, caregivers, healthcare facilities, insurance providers, and other persons arranging transportation services (“Passenger,” “you,” or “your”).
By requesting, scheduling, or using our services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
2. HAQQ Transportation Services
HAQQ Transportation provides non-emergency transportation within Chicago and surrounding suburbs, subject to availability and service-area limitations.
Our services include:
- Hospital Discharge Transportation
- Medical Appointment Transportation
- Pharmacy Trips
- Personal Transportation
- Airport Pickup & Drop-Off
- Other transportation services expressly agreed upon in advance by HAQQ Transportation.
3. Non-Emergency Transportation
HAQQ Transportation provides non-emergency transportation only. Our services are not a substitute for an ambulance, emergency medical transportation, or emergency medical care.
If a passenger is experiencing a medical emergency or requires immediate medical attention, 911 or an appropriate emergency medical service should be contacted.
4. Hospital Discharge Transportation
HAQQ Transportation may provide transportation from a hospital or healthcare facility following discharge to an approved destination.
The passenger, healthcare facility, caregiver, or responsible party is responsible for ensuring that the passenger has been medically cleared for the requested form of transportation.
HAQQ Transportation may decline transportation if it reasonably appears that the passenger requires emergency medical transportation, ambulance services, medical monitoring, or a level of care that HAQQ Transportation is not equipped or authorized to provide.
5. Medical Appointment Transportation
HAQQ Transportation may provide non-emergency transportation to and from medical appointments, hospitals, clinics, rehabilitation facilities, dialysis centers, and other healthcare-related destinations.
HAQQ Transportation does not provide medical treatment during transportation unless a specific service has been expressly agreed upon and is legally permitted. Drivers are transportation personnel and are not necessarily medical professionals.
6. Pharmacy Trips
HAQQ Transportation may provide transportation to and from pharmacies for prescription pickup and other pharmacy-related needs.
Payment for pharmacy transportation will be handled according to the applicable payer arrangement, authorization, or private-pay agreement. Insurance or government-program reimbursement is not guaranteed and is subject to the applicable plan or program requirements.
7. Personal Transportation
Personal transportation is a private-pay service unless otherwise agreed in writing. Payment is handled directly by the passenger or the person arranging the transportation.
Personal transportation may include transportation for personal errands, shopping, appointments, or other destinations agreed upon with HAQQ Transportation.
8. Airport Pickup & Drop-Off
Airport pickup and drop-off is a private-pay service unless otherwise agreed in writing. Payment is handled directly by the passenger or the person arranging the transportation.
Passengers are responsible for providing accurate airport, airline, flight, pickup/drop-off, and passenger information. HAQQ Transportation may monitor publicly available flight information when reasonably possible, but this does not guarantee that all flight changes will be identified.
HAQQ Transportation is not responsible for missed flights, airline charges, hotel charges, missed connections, or other losses resulting from traffic, weather, flight changes, airport restrictions, passenger delays, or other circumstances beyond HAQQ Transportation’s reasonable control.
9. Insurance and Third-Party Payments
For services eligible for third-party reimbursement, HAQQ Transportation may submit claims or invoices to the applicable insurance company, healthcare organization, government program, managed-care organization, or other authorized payer.
Reimbursement is subject to the payer’s eligibility, authorization, coverage, documentation, and payment requirements. HAQQ Transportation does not guarantee that an insurance company or other third-party payer will approve or reimburse any particular transportation service.
Where prior authorization is required, transportation may be subject to obtaining the required authorization before the trip.
10. Private-Pay Services
Personal Transportation and Airport Pickup & Drop-Off are private-pay services unless otherwise agreed in writing.
For private-pay services, the applicable fare or quoted price will be communicated to the customer before the trip whenever reasonably possible. HAQQ Transportation may require full payment in advance, a deposit, payment at the time of service, or another arrangement agreed upon by HAQQ Transportation.
HAQQ Transportation may decline or cancel a private-pay booking where required payment has not been received.
11. Booking and Reservation
A transportation request submitted through the website, telephone, email, or another approved method is a request for transportation and does not necessarily guarantee that a ride has been confirmed.
A booking becomes confirmed when HAQQ Transportation accepts or confirms the reservation.
Passengers should provide accurate pickup location, destination, date, requested pickup time, passenger information, mobility or accessibility requirements, contact information, and other information relevant to the transportation request.
12. Pickup Times and Delays
HAQQ Transportation makes reasonable efforts to arrive within the agreed pickup window. Transportation times may be affected by traffic, road closures, weather, construction, accidents, vehicle issues, healthcare-facility delays, airport conditions, passenger delays, and other circumstances outside our reasonable control.
HAQQ Transportation does not guarantee an exact arrival time unless expressly agreed in writing. Passengers should allow sufficient time for medical appointments, flights, check-in requirements, or other scheduled activities.
13. Passenger Mobility and Assistance
Passengers must disclose relevant mobility or accessibility needs at the time of booking, including wheelchair use, walker or cane use, difficulty walking, assistance entering or exiting the vehicle, or other relevant mobility considerations.
Passengers should provide accurate information so HAQQ Transportation can determine whether the requested transportation can be safely provided.
HAQQ Transportation may decline a trip when the passenger’s needs exceed the equipment, vehicle, staffing, or level of assistance available for that trip.
14. Wheelchairs and Mobility Equipment
Passengers using wheelchairs or other mobility equipment must inform HAQQ Transportation before the trip.
Mobility devices must be appropriately secured during transportation. HAQQ Transportation may decline transportation where a mobility device cannot be safely accommodated or secured in the available vehicle.
15. Passenger Conduct
Passengers and accompanying individuals are expected to behave respectfully toward HAQQ Transportation drivers and personnel.
Passengers may not engage in threatening behavior, violence, harassment, abuse, discriminatory conduct, illegal activity, property damage, or other conduct that creates an unreasonable safety risk.
HAQQ Transportation may terminate a trip or refuse future transportation where reasonably necessary to protect the safety of the passenger, driver, other passengers, or the public.
16. Alcohol, Drugs and Illegal Substances
Passengers may not use, possess, distribute, or consume illegal drugs or controlled substances in a HAQQ Transportation vehicle.
Open alcoholic beverages or behavior resulting from intoxication that creates a safety concern may result in refusal or termination of transportation.
Nothing in this section prevents lawful possession or use of medication as prescribed or permitted by law.
17. Minors and Vulnerable Passengers
A parent, guardian, caregiver, healthcare representative, or other responsible adult may be required to accompany a minor or passenger who requires supervision, depending on the circumstances of the trip.
HAQQ Transportation does not assume responsibility for providing continuous supervision, medical care, or personal care beyond the transportation assistance expressly agreed upon.
18. Cancellation and No-Show
Passengers should provide as much notice as reasonably possible when cancelling or changing a trip.
A no-show may occur when the passenger is not ready or available at the agreed pickup location; cannot be located after reasonable attempts to contact them; refuses transportation after the vehicle arrives; arrives too late for the scheduled transportation; or fails to cancel within the applicable cancellation period.
For private-pay services, cancellation and no-show fees may apply where disclosed at the time of booking. Insurance-billed transportation may be subject to the applicable payer’s cancellation and no-show requirements.
19. HAQQ’s Right to Refuse or Cancel Transportation
HAQQ Transportation may refuse, postpone, or cancel transportation where reasonably necessary because of unsafe road conditions, severe weather, vehicle problems, passenger behavior, inadequate or inaccurate passenger information, medical needs beyond the service’s capabilities, lack of required authorization, failure to make required private payment, safety concerns, or circumstances beyond HAQQ Transportation’s reasonable control.
Where reasonably possible, HAQQ Transportation will notify the passenger or responsible party of a cancellation or change.
20. Personal Belongings
Passengers are responsible for their personal belongings.
HAQQ Transportation is not responsible for lost, stolen, or damaged personal property except to the extent caused by HAQQ Transportation’s negligence or as otherwise required by applicable law.
Passengers should check the vehicle before exiting. If an item is found after a trip, HAQQ Transportation may make reasonable efforts to contact the passenger and arrange return of the item.
21. Vehicle and Passenger Safety
Passengers must comply with reasonable safety instructions provided by the driver. Seat belts must be worn where required by law. Passengers may not interfere with the driver’s operation of the vehicle.
The driver may refuse to begin or continue a trip when a passenger’s conduct creates an immediate safety concern.
22. Driver Responsibilities and Limitations
Drivers have authority to take reasonable steps necessary to protect the safety of the passenger, driver, other passengers, and the public.
Drivers may not provide services outside their training, authorization, or applicable law. Drivers are not authorized to make medical decisions for passengers.
23. Emergency Situations
HAQQ Transportation is a non-emergency transportation provider.
If a passenger experiences a medical emergency during transportation, the driver may contact emergency services and take other reasonable steps necessary to obtain emergency assistance.
HAQQ Transportation does not guarantee the availability of medical treatment or emergency medical intervention during a transportation trip.
24. Liability
HAQQ Transportation will provide transportation services with reasonable care and in accordance with applicable laws and regulations.
To the fullest extent permitted by applicable law, HAQQ Transportation will not be responsible for losses arising from circumstances outside its reasonable control, including traffic, weather, road closures, accidents caused by third parties, airport conditions, facility delays, or other unforeseen events.
Nothing in these Terms and Conditions is intended to exclude or limit liability that cannot lawfully be excluded or limited under applicable law.
25. Circumstances Beyond Our Control
HAQQ Transportation is not responsible for losses caused by circumstances outside its reasonable control, including traffic congestion, weather, flooding, road closures, construction, accidents, government restrictions, airport delays, flight cancellations, healthcare facility delays, vehicle breakdowns, public emergencies, or other unforeseeable events.
Where possible, HAQQ Transportation will make reasonable efforts to minimize the impact of such circumstances.
26. Indemnification
To the extent permitted by applicable law, a passenger or responsible party agrees to be responsible for losses, damages, or expenses arising from their intentional misconduct, unlawful conduct, or material violation of these Terms and Conditions.
Nothing in this section requires a passenger to indemnify HAQQ Transportation for HAQQ Transportation’s own negligence or other liability that cannot legally be transferred to the passenger.
27. Privacy and Personal Information
HAQQ Transportation may collect and use personal information necessary to schedule, provide, administer, communicate about, and bill for transportation services.
Information may include name, phone number, email address, pickup and destination information, appointment information, insurance information, transportation requirements, and other information reasonably necessary to provide the requested service.
Personal information will be handled in accordance with HAQQ Transportation’s Privacy Policy and applicable law.
28. Accuracy of Information
Passengers and persons arranging transportation are responsible for providing accurate and complete information.
HAQQ Transportation is not responsible for problems caused by inaccurate information supplied by a passenger, caregiver, facility, insurer, or other person arranging the transportation.
29. Website and Booking Information
Information displayed on the HAQQ Transportation website is provided for general informational purposes.
Availability, pricing, service areas, and other information may change without notice. Submitting an online booking request does not automatically guarantee that transportation has been accepted or confirmed.
30. Changes to Services and Terms
HAQQ Transportation may modify its services, policies, prices, and these Terms and Conditions from time to time. The updated version will be posted on the HAQQ Transportation website with an updated effective date.
31. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the State of Illinois, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Any dispute shall be handled in accordance with applicable Illinois law and the jurisdiction of courts having proper authority.
32. Severability
If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue to remain in effect to the extent permitted by law.
33. No Waiver
A failure by HAQQ Transportation to enforce any provision of these Terms and Conditions shall not constitute a waiver of its right to enforce that provision or any other provision in the future.
34. Entire Agreement
These Terms and Conditions, together with any applicable booking confirmation, pricing agreement, cancellation policy, privacy policy, and other written agreement between the passenger and HAQQ Transportation, constitute the applicable agreement governing the transportation services.
